                Sh. Kunal Juneja Adv. for the opposite party No. 2.

                Opposite party No. 1 already ex parte.

                Learned counsel for the opposite party no. 2 has made the statement that he is ready to pay Rs. 61000/- as settlement within 45 days, subject to deposit the handset alongwith assessor with the opposite party No. 2.  The disputed handset should not be damaged or  liquefied.

                Learned counsel for the complainant has made the statement that he has heard the statement and he has no objection for giving the order by this Forum according to statement of learned counsel for the opposite party No. 2.

                In view of the statement given by both the parties, the opposite party No.2 is directed to pay Rs. 61000/- (Sixty one thousand rupees only) to the complainant within 45 days after depositing the handset along with all accessories with the opposite party no. 2. In case of failure, the opposite party No.2 will pay the interest at the rate of 9% on the aforesaid amount of Rs. 61000/- (Sixty one thousand rupees only) to the complainant from the date of filing of complaint till its realization.  Hence, the complaint is disposed off. File be consigned to the record room after due compliance.
