Complainant is present a nd files a petition to serve summon of this ca se upon O.Ps. by making publication on “News papers”.  Let it be registered as Misc.  Case No.54 of 2017.

Heard, perused the petition and materials on record.

It appears that summons of this case could not be served upon O.Ps.  by ordinary way, despite several attempts were made.

In view of above facts and circumstances we have sufficient reasons to believe that O.Ps. are keeping themselves out to avoid service of summons.

So we are inclined to serve summons of this case by invoking provision of order V Rule 20 of the CPC by making publication in a News paper.

Hence, it is

That the Misc. Ca se no. 54 of 2017 be and same is allowed.

Complainant is directed to cause service of summons of this case upon all O.Ps. by making publication in a daily news Papers (probably in English daily News paper) circulated in the locality of O.Ps. where they ordinarily reside or carry their respective business.

Fix 17-10-2017 for draft of publication.

Thus this Misc.  case is disposed of.
