            The O.P No.s 2, 3 and 4 file hazira. The complainant is absent.

            Record reveals that by order No. 16 dated 10.04.2018 the complainant has been directed to file show cause for his nonappearance but on 19.04.2018 and today i.e. 07.05.2018 he neither filed show cause not took any steps.

            The petition dated 19.04.2018 filed by the O.P No.2 Laxmi Automobile for dismissal of the case for nonappearance of the complainant for last time is taken up for hearing.

            Heard Ld. Advocate of the O.P No.2 and other contesting O.Ps.  

            We find that since 10.04.2018 the complainant has not been taking steps. We further find that the complainant has filed the present case on 03.11.2016. But he has not filed any evidence as yet. Rather he has not been taking steps, even has not filed any show cause for nonappearance. It seems that the complainant is not willing to proceed with the case and he has no case at all and the petition dated 19.04.2018 filed by the O.P No.2 is liable to be allowed.

Hence,

Ordered

that the petition dated 19.04.2018 filed by the O.P No.2 Laxmi Automobile for dismissal of the case is allowed and C.C case No.131/2016 be and the same is dismissed for non-prosecution.

Copy of this order be supplied to the parties each free of cost.
