The case of the complainants in short is that complainants deposited Rs.20,000/- on 17.1.11 to International Country Holidays a division of Country Club of India Ltd. i.e. o.p. and photocopy of the receipt has been annexed by complainant with the petition of complaint. O.p. assured the complainants that they would issue membership card to that effect and which was facilitated to avail of various opportunities of o.p. with avail of opportunities of visiting of various places. Complainants interalia stated that ultimately o.p. did not do the same and being aggrieved complainants filed the instant case before the Forum for redressal with the grievances of deficiency of service to the complainants by o.p.
O.p. appeared before this Forum by filing w/v and contested the case. O.p. stated in their w/v that the instant case be dismissed due to the allegations which have been made by complainants is baseless and false and totally concocted.
Decision with reasons:
Upon considering the submissions of the parties and on careful scrutiny of the entire materials on record we find that the instant case has been filed by one Mr. Jnan Ranjan Das and one Mrs. Bijaya Das whereas Rs.20,000/- has been deposited by one Jona Ranjan Das which is evident from the receipt being no.CVCL-2091 dt.17.1.11 which has been annexed by complainants with the petition of complaint and there is no existence of complainant no.2 in the said receipt. So, it is crystal clear that the case suffers from appropriate complainant and as such, we hold that the instant case must be dismissed since complainants have no locus standi to file the instant case before this Forum for adjudication and/or redressal in respect of deficiency of service by them to o.p. In this connection it is needles to mention without any deposition of consideration nobody termed as consumer. Upon considering above facts and circumstances, this Forum rejects the instant case due to want of appropriate locus standi of the complainants.
Hence, ordered,
That the case is dismissed on contest without cost against the o.p.
Supply certified copy of this order to the parties free of cost.
