ORDER

Per Justice Shri S.B.Mhase, Hon'ble President: 

Adv.Ms.Kirti Pawar for appellant argued for sometime.  Ultimately, she submitted that since the cane supplied to the sugar factory was a gate-cane and there is no relationship of a consumer.  She also submitted that so far as irrigation society is concerned, she is not member of the society and she has not availed or hired any services from the society.  Ultimately, she submitted that relationship of consumer cannot be established and therefore, she has taken instructions from the appellant and she also stated that leave to withdraw the appeal may be granted with a liberty to follow alternative remedy available to the appellant.   

We find her prayer appropriate and therefore, we allow the complaint to be withdrawn with a liberty to follow alternative remedy available.  Appeal accordingly stands disposed of.  Hence, we pass the following o5rder:-

 

 

                                                :-ORDER-:

 

1.                 Appeal stands disposed of as withdrawn.

 

2.                 However, liberty is hereby granted to the complainant to follow  alternative remedy available.

 

3.                 Dictated on dais.

 

4.                 Copies of the order herein be furnished to the parties.
