Final Order / Judgement

A/1107/2019

Date: 28.12.2023

This appeal is filed on 22.07.2019 by OP Nos.1 and 2, aggrieved by the order dated 07.03.2019 passed in CC/35/2018.  Commission perused the previous proceedings sheet. Thereby found no grounds to keep this appeal at the same stage.  It is to be noted herein that there is a delay of 100 days in filing the appeal and the Forum below direction OP Nos.1 to 4 to refund Rs.2,18,000/- along with interest @ 09% p.a. from the date of complaint till realization and held complainant is entitle to get refund of Rs.1,20,000/- which is paid to the landlord of Sy.No.19/H and also held complainant is also entitle to recover Rs.20,000/- towards compensation for mental agony along with interest @ 09% p.a. from the date of complaint till realization and Rs.20,000/- towards compensation for deficiency of service and in such circumstances, keeping the appeal at the same stage certainly would put complainant/the consumer to suffer hardship.  Hence proceed to dismiss the appeal for default and non-prosecution.

The Amount in deposit is directed to be transferred to Forum below for needful.
