Final Order

        None is present on the behalf of the complainant. It is seen by us on scrutiny of the record that after admission of this complaint, notice was issued to the OP. The date was fixed on 22.08.2017 for S/R and appearance by the OP. On the said date in presence of the complainant, this Ld. Forum was pleased to direct the complainant to mention the address of the OP as the address of the OP was not mentioned in the Cause Title of the Complaint. The complainant was directed to take necessary steps by incorporating the address of the OP in the Cause Title

of the complaint. Date was fixed on 24.10.2017 for taking necessary steps by the complainant. On 24.10.2017 none was present on behalf of the complainant.

       For the ends of justice, further date was given to the complainant for taking steps on 12.03.2018. On 12.03.2018 due to resolution taken by the Local Bar, no positive order was passed and this Ld. Forum was pleased to fix this record on today i.e. on 11.07.2018 for taking steps by

the complainant. Today also no step has been taken by the complainant and moreover the complainant is absent on calls. The action of the complainant reveals that the complainant has lost his interest to proceed with this complaint. Since admission of this complaint on  02.05.2017 to till date no step has been taken by the complainant for incorporation  of the address of the OP in the Cause Title of the complaint.

      Therefore, since admission this record could not be proceeded one inch due to lacuna on behalf of the complainant.

      Under the circumstances, we have no option but to dismiss the complaint for default.

       Hence, it is ordered that CC  No. 226/2017 is  hereby  dismissed  for default. There is no order as to cost.

       Let plain copy of this order be given to the parties free of cost as per CPR, 2005.
