ORDER
SRI. P.V. JAYARAJAN, PRESIDENT:
This complaint filed under section 35 of Consumer Protection Act 2019. Stood over to this date for consideration and the Commission passed the following:
- This complaint relates to alleged unfair trade practice and deficiency in service on the part of the opposite party online travel services company in levying commission charges styled as “ convenience or service charges” from the complainant for fights that have been cancelled by the airlines itself. After admitting the complaint notice issued to the opposite party and the case was posted to 26/11/2021 for appearance of the opposite party.
- On 28/07/2021 the complainant filed IA.243/21 to advance the hearing date from 26/11/2021 with a memo stating that the dispute between the complainant and opposite party has been amicably settled. The said IA for advance hearing was allowed by order dated 28/07/2021 and the matter is advanced from 26/11/2021 to this date i.e., 30/07/2021.
- The complainant submitted that the subject matter in the complaint has been amicably settled by the parties to the dispute, and hence the complainant is not indenting to further proceed with the complaint. The complainant also filed a memo dated 28/07/2021 to that effect. As the matter is settled between the parties and the complainant filed a memo not pressing the complaint, the complaint is liable to the dismissed.
- In the result the complaint is dismissed as not pressed. No order as to cost.
