JUDGMENT

The present appeal has been filed against the judgment and order dated 9.5.2023 passed by the Ld. District Consumer  Forum, Muradabad in  complaint case no.41 of 2021, Mazhar M. Khalid vs. National Insurance Co. Ltd.

The brief facts of the appeal are that, that the complainant got insured his Toyota Innova no.UP 21 BK 1010 from the opposite party National Insurance Co. Ltd. which was valid from 2.1.2018 to 1.1.2019. The insurance company has not provided copy of any terms and conditions to the complainant at the time of taking premium amount of the aforesaid insurance. On 5.9.2018, the insured vehicle met with an accident, the information of which was given to the insurance company who appointed surveyor Sri V.P. Singhal who after survey assessed the loss and submitted his report to the insurance company.

The insurance company assured the complainant that amount of claim will be paid to the complainant but the insurance company did not honour the claim and denied the claim of the complainant as “no claim”. Aggrieved by the act of the insurance company, the complainant filed a complaint before the ld. District Consumer Forum Muradabad who after considering all the facts and circumstances of the case passed the following judgment.

“परिवादी का परिवाद स्‍वीकार किया जाता है। विपक्षी बीमा कम्‍पनी को आदेशित किया जाता है कि वह परिवादी को उसके वाहन की बीमित धनराशि 28700/-रू0  में से 6557/- रू0 नो क्‍लेम बोनस की धनराशि घटाते हुए (287000-6557=280443) 280443/- रू0 (दो लाख अस्‍सी हजार चार सौ तैतालिस रू0) वाद दायर करने की तिथि से वा‍स्‍तविक भुगतान की तिथि तक 06 प्रतिशत वार्षिक ब्‍याज सहित तथा 10,000/-रू0 (दस हजार रू0) आर्थिक व मानसिक क्षतिपूर्ति तथा 10,000/-रू0 (दस हजार रू0) वाद व्‍यय व अधिवक्‍ता फीस के रूप में एक माह के अन्‍दर भुगतान करें। ”

I have heard ld. counsel for the parties and perused the impugned judgment and order. 

The order passed by the ld. District Forum is justified. However, so far as the amount with regard to compensation for financial loss and metal harassment of Rs.10,000.00 is concerned, the same is excessive and is liable to be set aside. 

 Accordingly, the appeal is allowed in part.

The judgment and order dated 9.5.2023 is modified to the extent that Rs.10,000.00 compensation for financial loss and metal harassment is set aside. The rest part of the judgment is confirmed.

If any amount is deposited by the appellant at the time of filing of this appeal under section 15 of the Consumer Protection Act, 1986, may be remitted to the District Forum concerned for satisfying the decree as per rules alongwith accrued interest upto date.

The stenographer is requested to upload this order on the Website of this Commission today itself. 

Certified copy of this order be provided to the parties in accordance with rules.
