Learned Counsel for the Appellant is present and filed an affidavit stating that as per the direction of Hon'ble Commission she has deposited Rs.50,000/- before Opposite Party on 02-08-2023 towards the defaulted amount and she has also filed payment acknowledgment, same be kept in record.
Heard the learned Counsel appearing on behalf the Petitioner.
On perusal of records, we find that the Complainant has filed the Consumer Complaint bearing no. 235/2023 before learned DCDRC, Khurdha with prayer to pass appropriate order permanently restraining the Opposite Parties from seizing/repossessing the vehicle of the Complainant bearing Registration No. OD-29-F-9949 and claiming compensation, mental agony and litigation expenses. Learned Counsel for the Petitioner has also filed I.A. No. 94/2023 with a prayer not to seize/reposes the vehicle of the Complainant bearing Registration No. OD-29-F-9949.
Counsel for the Petitioner further submitted that the Complainant is a senior citizen and not able to arrange money to comply with the order dt.30-06-2023 of learned District Commission, Cuttack and prayed to allow some more time to deposit the amount.
Taking into consideration the health condition of the Complainant and the submission made on behalf of the learned Counsel of Complainant and further taking into consideration the fact that in the mean time the Complainant has already deposited Rs.50,000/-, we direct the Opposite Parties not to seize the vehicle of Complainant bearing Registration No. OD-29-F-9949. Further the Complainant is directed to pay/deposit an amount of Rs.1,00,000/-(Rupeees one lakh)only with Opposite Parties within one month from the date of this order and shall go on depositing/paying the regular EMI to the Opposite Parties.
The Revision Petition is disposed off accordingly.
