The complainant is not attending the Forum since long time. Mr.Sarfraj Ahmed Khan, Adv. for the O.P. is present. The opponent has filed say on delay condonation application filed by the complainant. On perusal of complaint, it appears that the complainant failed to pay the instalments. Therefore, the vehicle was taken by the opponent. The complainant has prayed for return of vehicle. It does not come within the scope of deficiency in service. Therefore, the complaint itself is not maintainable. Hence, the complaint is dismissed for want of prosecution.
