Final Order / Judgement

The case record is posted today for hearing of the case. None present on behalf of the either parties nor any steps are taken on their behalf. On repeated calls, both the parties are also absent.

As it appears from the case record, the O.P No.1 was set ex-parte though appeared and filed w/v beyond the statutory period, whereas the O.P No.2 appeared and filed w/v. The Complainant remained absent since 03.09.2018 till date and slept over the matter for a long period and no step is taken on his behalf. From the above nature and conduct of the Complainant, it is clearly made out that the Complainant has no interest to prosecute his case and unnecessarily wasted the valuable times of this Commission. In the facts and circumstances of the case and considering the nature and conduct of the Complainant, this Commission is of the view that the complaint of the Complainant should be dismissed.

Accordingly, the complaint of the Complainant is dismissed for non-prosecution of the case. The interim order, if any, passed earlier against the O.Ps shall remain infructuous. Further, the O.Ps are at liberty to collect outstanding revenue, if any, from the Complainant or its representative by using fair means and method.
