Chhinder Pal Versus Mahindra & Mahindra & ors

Present :- Sh.Pushpinder Kapoor, Advocate Counsel for the Complainant.

1 Today case is fixed for evidence of the Opposite Party No.3 & 4, but instead of adducing any evidence by Opposite Party No.3 & 4, Counsel for the Opposite Party No.3 & 4 i.e Insurance Company, Sh.Raman Kumar Sharma, Advocate suffered a statement that the Insurance Company is ready to compromise with the Complainant by way of making payment of the damages claim amount on substandard basis i.e. 75 % of the loss assessed by the Surveyor which comes of Rs.2,74,000/- and further stated that the said amount will be paid by the Insurance Company i.e. Opposite Party No.3 & 4 within 45 days from the receipt of copy of the order.

1 Similarly, Complainant Sh.Chhinder Pal as well as his Counsel Sh.Pushpinder Kapoor, Advocate suffered a statement which has been recorded separately that they have heard the above said statement of Counsel for the Opposite Party No.3 & 4 and accept the same and compromise the matter and ready to receive the amount of Rs.2,74,000/- as full and final settlement of the claim of the complainant and further stated that the complaint may be decided accordingly.

3 In view of the statements made by Counsel for both the parties as well as Complainant, the matter at this stage has been compromised by amicably and accordingly Insurance Company i.e. Opposite Party No.3 & 4 are liable to pay amount of Rs.2,74,000/- to the Complainant as full and final settlement of the claim of the complainant within 45 days from the date of receipt of copy of the order. In case, Opposite Party No.3 & 4 i.e. Insurance Company will fail to make the said amount within stipulated period as agreed between them, then Insurance Company i.e. Opposite Party No.3 & 4 will liable to pay interest on the aforesaid amount @ 9% from the date of filing of complaint till its realisation and accordingly, this complaint is disposed of being compromised. Copy of this order be supplied to the parties free of costs under the rules. File be consigned to the record room.
