This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties.  After admitting the complaint notice was issued to the opposite parties to appear before this Commission today.  When the case came up for consideration today the opposite parties entered appearance through counsel and submitted that they are ready to pay the claim amount of Rs.34,730/- to the complainant.  The complainant who was present before this Commission agreed for the settlement.  The opposite parties counsel handed over a DD for an amount of Rs.34,730/- in the name of the complainant to the complainant from the open court.  In pursuant to that the complainant made an endorsement on the complaint stating that he has received DD for Rs.34,730/- and as matter settled he is not willing to further proceed with this complaint.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.    

In the result the complaint is dismissed as settled.  There will be no order as to cost.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
