             Shri Ravindra Tiwari with Ms. Anika Bajpai, learned counsel for appellant.

             Shri Vishnu Tiwari, Advocate appears for respondent.

             In response to IA-3, application for urgent hearing this case has been listed today for consideration of compromise/settlement entered into between both parties and adhereing application which has been signed by both the counsel.

              From the averments made in the application, IA-4, it has been stated that the appellant and the respondent have agreed to settle the dispute between them on payment of Rs.40,000/- by the respondent to the appellant.  In view of the above statement the respondent has handed over a demand draft no. 688784 dated 15.02.2017 for Rs.40,000/- drawn on HDFC Bank in favour of appellant Sanjay Dengre.  Copy of demand draft has also been annexed with the application. It has been further submitted that in the light of the above

settlement an appropriate order may be passed.

               Learned counsel for appellant admits the said compromise and receipt of draft of Rs.40,000/-.  She submits that in view of the above settlement there remains nothing for appellant to continue this appeal, therefore, he seeks to withdraw this appeal.

               In view of the averments made in the application and the submissions made by counsel for parties, the application is allowed and the appeal is dismissed as withdrawn.
