          Manjit Kaur Vs. Mahinder & Mahindera Fin. Service

Present: Shri Gurmeet Singh Advocate for DH.

     Shri Vineet Rathore Advocate for JD.

 

The DH has filed the execution petition for compliance of order dated 11.04.2017 passed by this Forum, wherein he prayed that OP/JD be passed to execute from no.35 for deletion of hypothecation clause from the registration record and no objection. The counsel for JD on 02.11.2017 obtained from no.35 duly signed by the DH for getting the same signed from the JD and be made a separate statement. The case was adjourned to 15.11.2017. On 15.11.2017 the learned counsel for JD produced original NOC (two copies) and from mo.35 (two copies) in this Forum in compliance of DH. Separate statement of both the counsels were recorded separately. The learned counsel for JD also stated in his statement that the JDs have harassed the complainant for last five years so complaint was decided on 11.04.2017 ans a compensation of Rs. 20,000/- has been awarded to the complainant against the OPs. Therefore, the contention of counsel for DH that the JD has been harassing her for the last five years has no force. Hence the present execution petition is hereby dismissed. File be consigned to record after due compliance.
