This complaint filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite party alleging deficiency in service in respect of amount due from the opposite party in connection with exchange money transfer in Canadian dollars. The opposite party filed version denying the allegation of deficiency in service. The complainant filed chief affidavit on 25.09.2017. Since 02.08.2018 the complainant is continuously absent. In order to substantiate the case put forward by the complainant against the opposite party, the complainant has not marked any documents in spite of giving sufficient opportunities to the complainant. As the complainant has failed to utilize those opportunities for adducing evidence to establish his case, we find that the complainant has miserably failed to establish his case. There is no material evidence before this Commission from the side of the complainant. In the above circumstances as the complainant failed to establish his case put forward against the opposite party, we find that this is a fit case to be dismissed.
In the result, the complaint is dismissed. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
