            On perusal of records and after having heard the oral arguments of both parties we delivered the following:

ORDER

            The complainant has filed this complaint under section 12 of the Consumer Protection Act, 1986 for seeking direction to provide new vehicle by taking back the defective vehicle Mahindra XUV 500 W6 and to pay a sum of Rs.15,00,000/- towards compensation and to pay a sum of Rs.5,00,000/- towards deficiency in service along with cost.

2. In order to prove the case, on the side of the complainant, the proof affidavit submitted as his evidence and Ex.A1 to Ex.A39 documents were marked.  While so, on the side of the 1st opposite party, the proof affidavit submitted as his evidence and Ex.B1 and Ex. B34 documents were filed. In spite of notice duly served to the 2nd and 3rd opposite parties from this commission, the 2nd and 3rd opposite parties neither appeared nor represent and hence the 2nd and 3rd opposite parties were called absent and set ex-partie.

            3. The averments of the complaint in brief are as follows:-

The complainant purchased Mahindra XUV 500 W6 vehicle bearing Registration No.TN.46-U-9999 on 28.10.2011 from the 2nd opposite party.  The complainant had travelled from Chennai to his native place Peramballur, wherein the above said vehicle had encounter the vibration and also left side pulling. Further within a week the gears were not functioning in a smooth manner.  The problem had encountered in the above said vehicle at frequent intervals and the gear box was not functioning in a smooth manner and the above vehicle was given to 2nd opposite party for same and changed the gear box oil with synthetic oil and some following problems

i) Head light Assembly                              -5times

v) Wiper Window Assembly                   -1time

vi) Clutch plate                                            -2times

vii) Front Brake Dises                                -1time

ix) Rear Brake Pad                                      -1time

x) Left front tyre                                         -1time

xi) All tyres including extra tyre (5 nos)-1time

xii) Remote lock and key                          -1time

xiii) All four wheel suspensions              -1time.

 All the above problems were occurred within one year from the date of purchase and as per the terms of warranty the opposite parties are suppose to provide the new vehicle for the defective one and in spite of the complainant with repeated request and demand, the respondents never took any effective steps to replace the new vehicle instead the opposite parties had given evasive replies and tried to convince the complainant to cure the defect which is not acceptable and it is bounden duty of the opposite party to replace the defective vehicle and most of the time the above said vehicle has under the custody of 2nd opposite party for rectifying the defect.  Hence this complaint.   

            4.Written version of 1st opposite party in brief:-

            The allegation of manufacturing defect in the utility vehicle without relying on any export report from a recognized notified laboratory and there is baseless.  There is neither any manufacturing defect proved in the vehicle in question nor any deficiency in service being established against the 1st opposite party.  The complainant has failed to follow the guidelines given in the owner’s manual as recommended for smooth and maximum performance of the utility vehicle in question viz. Correct operating procedures and the terms and condition of warranty of the utility vehicle in question. As per terms and conditions of the warranty applicable for the subject of the vehicle irrespective of the distance covered, subject to fulfilment of other terms and conditions of the warranty. It is submitted that the complainant has purchased the utility vehicle on or around 28.10.2011 from the opposite party dealer and the said utility vehicle in question till 24.10.2013 has covered around 79,578 kms and it manifests that the utility vehicle in question within a period of 24 months had covered 3,315kms per month and the above said fact proves that the subject utility vehicle in absolute roadworthy condition and that the job carried out on the vehicle in question are minor and running repairs, which were required to be carried out due to regular, continuous, extensive and faulty usage of the said vehicle. After purchase, the vehicle in question reported of following occasions for service/repairs.  First time on 22.11.2011 at 4,819 kms (approx) for 1st free service along with the purported complaints of vehicle vibration on 100 to 120 kmph, LHS pulling, gear tight, brake sound front, outside temp sensor, front power window RHS front wherein scheduled service like change of engine oil & oil filter was done and the purported complaints were addressed by performing general check, wheel balancing, wheel alignment & cleaning brake.  Also, outside temp sensor & front RHS power window was checked and was found normal.

5.  Subsequently, the vehicle reported on 03.12.2011 at 5,824 kms (approx) for the complaint of check wheel alignment and was repaired by performing wheel alignment under the warranty.  The vehicle of the complainant then reported on 22.12.2012 at 7,647 kms for the problems of clutch hard, all door rattling, suspension noise, Bluetooth connection failure and RHS pulling and brake noise and was attended by arresting all door rattling noise, checking and clearing brake noise performing wheel alignment, replacing clutch disc & clutch cover and topping up transaxle oil under warranty.  Bluetooth connection was also checked and was found working properly.  Further the complainant has requested to provide non woven met (value added service) which was given on paid basis.  Afterwards, the vehicle reported on 20.01.2012 at 10,772 kms for 2nd free service apart from the issues of brake noise, steering vibration at 120kmph, front RHS parking light not glowing and re-fix fuse when recommended and service and general checks were done and the asserted issues were set right by cleaning all wheel brake, correcting parking light wiring & fixing fuse properly under warranty.  Also the steering was inspected wherein no such problem of vibration was observed.  Later the vehicle reported on 25.02.2012 at 14,710kms (approx) for the problem of steering wheel vibration at 120 kmph and was redressed by doing wheel balancing under the warranty.  The vehicle of the complainant reported again on 01.03.2012 at 16,039kms (approx) for accidental repairs when repairs were carried out on paid basis.  Once again the vehicle reported on 08.03.2012 at 16,330kms (approx) for the complaint of vehicle LHS pulling wherein the vehicle was duly checked and the alleged complaint was not found in the vehicle.

The subject vehicle further reported on 16.03.2012 at 18,705 kms (approx0 for the complaints of LHS parking light now glowing & wiper spray not working and was made right by changing kit windscreen washer & headlight assembly with projector lamps under warranty. Next the vehicle reported on 28.03.2012 at 19,076 kms (approx) for the issues of front LHS dragging & music system volume control not working properly wherein upon inspection, no such LHS dragging was confirmed in the vehicle and the other issue was arrested by changing silver box under warranty. Furthermore, the vehicle reported on 04.04.2012 at 21,246kms  (approx) for 3rd free service apart from the complaint of wobbling at a speed of 110-120 kmph, braking rear heavy noise, CD player volume control completely not functioning, horn not working, suspension noise on rough road, left pulling, a/c filter clean & all lights check when maintenance services & standard checks were done and the purported complaints were attended by cleaning all wheel brake, checking & arresting rear wheel brake noise & suspension noise and replacing CD player silver box & horn steering coil spring under warranty.  The said car then reported on 26.04.2012 at 22,957 kms (approx) for the problems of vehicle LHS pulling, steering vibration at 115-120 kmph, rear LHs tyre inner wear, brake noise in hills even when brake not applied & steering wheel not straight and was repaired by performing tyre rotation and changing one wheel tyre & brake pad it assembly under warranty. Thereafter, the vehicle reported on 03.05.2012 at 23,150kms (approx) for the complaint of brake noise and was resolved by changing rear LHS calliper under warranty.

The vehicle of the complainant reported again on 07.05.2012 at 24,904kms (approx) for the issues of $RHS head light aiming & jerk to check, infotainment jumps from CD to FM/FM to CD, brake noise, left pulling & RHS bottom bulb to fix & ABS indicator glowing and was made right by wheel alignment, cleaning brake & replacing headlight assembly & silver box under warranty. Also wiring of ABS was checked and was found okay.  Once again the vehicle reported on 15.05.2012 at 25,075kms (approx) for the complaint of head light aiming and was repaired by head light focusing under warranty. Later the vehicle reported on 21.05.2012 at 25,256kms (approx) for the complaint of reverse light & parking light not working along with value added service of illuminated scuff plates to fit, side mirror & rear door chrome when it was attended by checking reverse light & parking sensor under warranty and fitting mirror cover, left gate handle chrome & illuminated scuff plates on paid basis. The vehicle in question next reported on 15.06.2012 at 28,519 kms (approx) for the problems of steering vibration at 100 to 120 kmph speed, left pulling, idle speed a /c not working, a/c on only at 3rd gear, head light low beam hanging 9focus to check) key remote not working, rear both side tyre inner wear, check all electrical system, rear brake noise, poor mileage, clutch head & check all suspension condition and was attended by performing jobs on a/c hose on paid basis and checking key remote & all electrical system, cleaning rear brake and replacing strut assembly, clutch cover disc, assy csc nozzle, hose pressure RH-pump to gear, headlamp assembly, power steering oil, tyre, tec., under warranty.

8.  Again the vehicle reported on 30.06.2012 at 28,525kms (approx) for tyre replacement when two tyres were replaced under warranty.  The subject vehicle subsequently reported on 03.07.2012 at 28,921kms (approx) for the problems of 100kmph vehicle vibration, left pulling, a/c low speed not working & tyre thread scratching rear both tyres and was addressed by checking vehicle vibration, left pulling & a/c and changing assy rear shock absorber & spring and brake disc front under warranty. Further the vehicle reported on 27.07.2012 at 31,548kms (approx) for 30,000 kms, service along with the complaints of rear RHS wheel brake noise, rear both tyres outer wear, hand brake adjust, power window main control LHS switch not working, key remote sometimes not locking, wiper blade not cleaning properly & brakes not working in cruise control mode wherein scheduled service like tyre rotation, wheel balancing, etc., were done and the purported complaints were redressed by adjusting hand brake, cleaning wheel brakes & changing wiper blades & power window switch under warranty. The said vehicle then reported on 25.08.2012 at 34,597kma (approx) for the issues of LHS pulling, clutch hard, suspension noise, remote key not working, vehicle left dragging while applying brake, all door inner handle paint peel off, brake noise, a/c no cooling in idle condition, in cruise control brake not working, all tyres outer wear & horn pad LHs not working and attended by doing LHS pulling alignment, lubricating & bleeding clutch, lubricating, suspension, cleaning brakes and replacing brake pad kit assembly under warranty.  Also remote key, a/c cooling, cruise control & horn pad was checked and was found to be working normal.

9. Afterwards, the vehicle reported on 04.09.2012 at 34,650 kms(approx) for washing wherein water wash was done and neither any complaint was reported by the complainant not observed by the workshop. The vehicle of the complainant then reported on 12.10.2012 at  40,210kms (approx) for the issue of power steering oil leak and was set right by changing hose pressure RH-pump to gear & power steering oil under warranty. Thereafter, the vehicle reported on 18.10.2012 at 41,202 kms (approx) for 40,000 kms service apart from the complaints of power steering oil level check, vehicle LHS pulling, vehicle drags to LHS after 100 kmph while braking, noise, rear wheel noise while driving up in slope, a/c no cooling after 40 km drive & fog formation, a/c effective only after putting rear a/c, suspension noise, clutch hard & engine temperature gauge showing two red band sometime wherein scheduled service & general checks were done.  Further the complaints of LHS pulling, vehicle drags LHS after 100 kmph while braking, noise, rear wheel noise while driving up in slope, suspension noise, clutch hard & engine temperature gauge showing two red band sometime were thoroughly investigated and were not found by the workshop.  Also a joint test drive was taken by the workshop along with the complainant during which also these complaints were not observed in the vehicle.  The other complaints were redressed by replacing evaporator core assy front, sensor evaporator, under body suction pipe & hose rear, etc., under warranty.

The vehicle in question later reported on 05.11.2012 at 41,378kms (approx) for the issue of both side view mirror glass position adjuster not working and was arrested by changing switch assy power window door driver under warranty. Afterwards, the vehicle reported on 26.11.2012 at 43,940kms (approx) for the problems of horn not working, horn pad hard to press& CD not loading and was resolved by replacing horn assy high tone, horn assy low tone & silver box under warranty. The subject vehicle reported on the next day i.e. 27.11.2012 at 43,985 kms (approx) for rear dickey door dent which was attended by denting & painting. Next, the vehicle reported on 12.12.2012 at 48,493kms (approx) for the problems of vehicle LHS pulling, steering vibration above 110 kmph speed, front LHS LED not working &fixing stepney tyre to front LHs when it was repaired by changing headlamp assembly & fixing Stepney tyre to front LHS under warranty.  The vehicle was inspected and the problems of LHS pulling & steering vibration were not observed.  The said vehicle further reported on 11.01.2012 at 50,779kms (approx0 for the complaint of all door side beading to fix, LHS pulling, brake very low & noise & rear noise while applying brake and was repaired by fitting door beading, wheel alignment, front both wheel balancing, cleaning rear brake and replacing brake pad kit assy under warranty.

11.Subsequently the vehicle reported on 13.02.2012 at 57,842kms (approx) for the issues of audio system getting off automatically while driving, RHS pulling, brake noise, siren glowing automatically & suspension noise and was addressed by wheel alignment, cleaning all wheel brake, checking suspension bolts torque & changing brake pad under warranty. The said vehicle furthermore reported on 01.03.2013 at 60,926kms (approx) for 60,000kms service along with the complaints of rear suspension noise & rear brake noise wherein recommended service & standard checks were done and the asserted complaints were duly attended under warranty. Later the vehicle reported on 18.03.2013 at 65,499 kms (approx) for the issues of dickey door not standing, rear brake noise, engine bottom force properly, front LHS head light check, suspension noise & tyre wear and was set right by charging batter, checking immobilizer, checking alternator supply, cleaning brake, etc.,  under warranty.  It may be noted that wheel alignment &wheel balancing was also required to be done but, the same not done as the complainant was in hurry. The said vehicle then reported on 27.04.2012 at 73,874kms (approx0 for the complaints of suspension tight, reverse siren not working, handbrake adjust, gear shifting time noise, rear LHS wheel arch beading new one keep it inside the vehicle & wheel alignment check and was repaired by suspension torque, enabling reverse siren adjusting handbrake, correcting gear shifting & wheel alignment under warranty. Later the vehicle reported on 08.06.2013 at 73,874kms (approx0 for accessory fitment wherein rain visors & wheel cover were fitted on paid basis. 

12.The vehicle of the complainant reported again on 11.06.2013 after covering 78,488kms for accidental repairs when denting & painting was done on a charge basis. Next the vehicle reported on 17.10.2013 at 79,473 kms (approx0 for 80,000 kms service along with the problems of steering vibration, front & rear brake noise, RHS pulling while braking, suspension noise, a/c motor loose connection, audio system Bluetooth not working, wheel pressing horn pad it disturbs the audio &strong keep changing & clutch not smooth wherein scheduled service & general checks were done and the alleged problems were redressed by changing strut assy, assy lower control arm front RHS, assy lower control arm LHS, assy link stab bar, rear shock absorber &spring, blower motor assy, etc., under warranty. The vehicle in question eventually reported on 24.10.2013 at 79,578 kms (approx) when the complainant has replaced the tyres from outside and requested the workshop to check the when alignment and the same was done under warranty and therefore it is requested that the complaint may be dismissed.

            13.The points for consideration are:-

1) Whether there is any deficiency in service on the part of the opposite parties?

2) Whether the complainant is entitled to get reliefs as claimed in the complaint?

3) To what relief, the complainant is entitled?

14. Point No.1:-

 

            On perusal of written version of the 1st opposite party and proof affidavit along with documents relied by him would prove that the complainant has hand over the vehicle to the 2nd opposite party for the first time on 22.11.2011. Even the first service itself the complainant’s vehicle has got problems of vibration on 100 to 120 kmph, LHS pulling, gear tight, brake sound front, outside temp sensor, front power window RHS front. The above defects were carried out and wherein scheduled service like change of engine oil and oil filter also changed. Thereafter the complainant’s vehicle handed over to the 2nd opposite party on 03.12.2011, 22.12.2011, 20.01.2012, 25.02.2012, 01.03.2012, 08.03.2012, 19.03.2012, 28.03.2012, 04.04.2012, 26.04.2012, 03.05.2012, 07.05.2012, 15.05.2012, 21.05.2012, 15.06.2012, 30.06.2012, 03.06.2012, 27.07.2012, 25.08.2012, 04.09.2012, 18.10.2012, 05.11.2012, 26.11.2012, 27.11.2012, 12.12.2012, 11.01.2013, 13.02.2013, 18.03.2013, 27.04.2013, 08.06.2013, 11.06.2013, 17.10.2013 and 24.10.2013 for rectification of defects and the above said facts was not denied by the 2nd opposite party and  it is admitted each and every time the complaints were rectified on free of cost. However as per admitted facts by the 2nd opposite party that the vehicle was carried repairs nearly 35 times within two years and therefore the complainant’s vehicle was under the custody of 2nd opposite party for carrying out repairs than it was plied on the road.

            15. It is clearly proved that the above said vehicle had got manufacturing defects and to disprove the same, the 2nd and 3rd opposite parties has not taken any proper steps. Hence we found that the vehicle has got manufacturing defects and also that the opposite parties committed deficiency in service on their part. Accordingly point No.1is answered.

            16.Point Nos.2 & 3:-

            We have discussed and decided that the opposite parties have committed deficiency in service and thereby the complainant is entitled to recover a sum of Rs. 10,56,181/- towards  the cost of the vehicle.  Further the complainant is entitled a sum of Rs.1,00,000/- towards deficiency in service and Rs.1,00,000/- towards compensation for mental agony caused to the complainant apart from a cost of Rs.10,000/- towards  cost of litigation. Accordingly point Nos.2 and 3 are answered.

            In the result, this complaint is allowed in part.  The opposite parties 1 to 3 are hereby directed to pay a sum of Rs.10,56,181/- (Rupees ten lakhs fifty six thousand one hundred and eighty one only) towards cost of the vehicle and Rs.1,00,000/- (Rupees one lakh) each towards deficiency in service and compensation for mental agony caused to the complainant apart from cost of Rs.10,000/- (Rupees ten thousand only).  The above amounts (Rs.12,66,181/-) shall be payable by the opposite parties 1 to 3 jointly and severely within three months from the date of this order, failing which the complainant is entitled to recover the same with interest at the rate of 9% per annum till the date of realization.
