                   Counsel for OPs.

          Learned counsel for opposite parties pointed out para no.1 of agreement for sale dated 14.03.2013 entered into the parties for sale of the flat. Wherein total sale price of the flat in dispute has been shown Rs.31,51,000/-.

         He further argued that the    Hon’ble National Commission in order dated 07.10.2016 passed in appeal no.644/2015 titled Parikshit Parashar V/S M/S Universal Buildwell Pvt. Ltd. and others held that for the purpose of pecuniary jurisdiction total sale price of the goods/property are to be seen.

                    Therefore, in view of law laid down by the Hon’ble National Commission in Parikshit Parashar’s case (supra) this forum has no pecuniary jurisdiction to decide this complaint.

                    Therefore, complaint be returned to the complainant for presentation before the Hon’ble State Commission. The parties are directed to appear before the Hon’ble State Commission on 11.09.2017 at 10:30 A.M. File be consigned to record room.
