It is stated that a settlement has been arrived between the parties wherein the petitioner has agreed to withdraw the complaint and the orders passed by both the fora below are set aside.  The

order will not be treated as precedent to the other consumer cases.  The petitioner can withdraw the amount in the sum of Rs.1,56,129/- already deposited by him in the State Commission, without prejudice and on humanitarian ground.  This order be treated as decree and the matter stands settled.  It is also made clear that whatever amount which is lying with the District Forum and the State Commission with accrued interest, be paid to the respondent/complainant.

The matter stands settled.  The file be consigned to record.
