This Revision Petition is listed today and, after hearing the arguments of the counsel for the Revision Petitioner and upon perusing the materials on record, this Commission passes the following:-

 

O R D E R

R.Subbiah, J. – President.   (Open Court)

 

                This Revision Petition is filed against the Order, dated 03.03.2020 passed by the DCDRC, Chennai (South) in C.C. No.274/2019, whereby, the District Commission has set the Revision Petitioner herein/ 4th Opposite party exparte for non-filing of written version for a long time and consequently, adjourned the Case to 10.03.2020 for filing written version of the 3rd Opposite party.

2.     Heard the Revision Petitioner / 4th Opposite party.  There was no representation for the respondents 1 & 2 / complainants 1 & 2.

3.     This Revision Petitioner / 4th Opposite party was set exparte for non-filing of written version for a long time.  When the matter had come up before this Commission, the Learned Counsel for the Revision Petitioner / 4th Opposite party stated that for submitting a detailed written version, he has to co-ordinate with the 5th respondent / 3rd Opposite party, who is a consultant at the Hospital and also to refer the incomplete documents produced by the 1st respondent / complainant.  Therefore, it took a considerable time which exceeds more than 45 days.   The Revision Petitioner / 4th Opposite party has represented through its Counsel for all the hearings except 03.03.2020.  Hence, unfortunately, the Revision Petitioner / 4th Opposite party was set exparte on 03.03.2020.  Thus, he prays for setting aside the exparte order dated:03.03.2020.   When that being the position, we are of the opinion that keeping the Revision Petition filed by the 4th opposite party pending will further delay the matter.   Since the reasons assigned by the 4th opposite party seems to be bonafide and also, in the interests of justice, we are inclined to allow this Revision Petition by setting aside the impugned order.

4. In the result, the Revision Petition is allowed and the impugned order, dated 03.03.2020, passed in C.C. No.274/2019 by the DCDRC, Chennai (South) in setting the Revision Petitioner / 4th Opposite party exparte is set aside, and the 4th Opposite Party shall file his Version, Proof Affidavit and the documents/exhibits on their side, if any, in C.C. No.274/2019 on the next date of hearing without fail, whereupon, the District Commission shall proceed with the case in accordance with law, for its early disposal.
