This appeal has been filed against the judgment of learned DCF Jaipur 4^th dated 7.4.2015 whereby the original complaint has been dismissed by the court below.

 

The contention of the appellant is that he has not been allowed to appear in the examination as he has not been enrolled with the Board of Technical Education and it is deficiency on the part of the respondent.

 

Heard the learned counsel for the parties and perused the impugned judgment as well as the original record of the case.

 

The original record of the case clearly speaks that admission card was issued to the appellant with particulars of papers and Anx. 4 to 8 clearly speaks that he remained absent and did not appeared in the examination. Hence, the contention of the appellant that he has not been allowed to appear in the examination is unfounded . When the admission card has been issued to him, it was the duty of the appellant to appear in the examination but he has not availed the opportunity and

unnecessary the complaint has been filed which has rightly been rejected by the court below. No interference is needed. The appeal is dismissed.
