Appellant Shri.Vishwnath Govind Jaybhaye as well as his counsel Shri.B.R.Jaybhay is also absent. None for the respondents is present, its counsel Smt. C.E.Gaikwad is also absent. On perusal of record it reflects that the matter pertains to the theft of electricity. Therefore, as per the recent decision dated 01/07/2013 of Hon'ble Appex Court in the case of “U.P.Power Corporation Ltd and Ors – V/s- Anis Ahmed” the consumer complaint itself is not being maintainable, appeal deserves to be dismissed and accordingly it is dismissed. No order as to cost.
