Heard learned counsel for the petitioner finally at admission stage. The State Commission vide impugned order dated 25.10.2013 dismissed the First Appeal no. FA/13/281 in default. Learned counsel for the petitioner submitted that on 25.10.2013, learned counsel for the petitioner could not reach to the State Commission due to traffic jam and appeal was dismissed in default on the first date, which may be restored. As appeal has been dismissed in default on the first date becuase learned counsel for the petitioner could not reach to the State Commission due to traffic jam, we deem it appropriate to set aside the impugned order and restore the appeal at its original number. Consequently, revision petition is allowed and impugned order dated 25.10.2013, passed by the State Commission in First Appeal No. FA/13/281, Smt. Rekha Vivek Dhamankar vs. Maharashtra State Electricity Distribution Company Limited is set aside and appeal is restored at its original number and matter is remanded back to the State Commission to proceed further in accordance with law. Petitioner is directed to appear before the State Commission on 18.02.2014.
