None is present for the appellant and the respondent when the appeal is taken up for final hearing at 4.10 p.m. The perusal of the earlier proceedings show that the representative of the appellant had appeared lastly on 16/01/2010. Thereafter he did not appear before this Commission.

The appeal came be adjourned on several dates. The earlier daily proceedings also shows that none was present for the appellant on 22/03/2010, 29/06/2010, 30/09/2010, 18/01/2011, 25/04/2011, 04/10/2012, 21/11/2012 and 06/02/2013. Last chance was also granted on 06/02/2013 for final hearing. Hence, we are satisfied that appellant is not interested in pursuing the appeal. Appeal is therefore dismissed in default.
