ORDER

Appellant purchased the premises from M/s Akar Enterprises.  In the building purchased by the appellant, an electricity meter had been installed in the name of M/s Akar Enterprises.  Since the arrears of electricity had not been paid by the previous owner, bill was issued to the appellant which was not paid.  Appellant filed the complaint against the bill raised by the respondents.      

             Respondents on appearance took preliminary objection that the appellant was not their ‘Consumer’ as the meter was not transferred in his name.  State Commission dismissed the complaint on this objection.

             Appellant being aggrieved filed the appeal which came up for hearing on 21.09.2012.  On the said date, counsel for the appellant made a statement that the appellant was prepared to pay all the outstanding arrears.  In view of the statement made by counsel for the appellant, subject to his paying the entire outstanding electricity dues respondent was directed to restore appellant’s electric connection.

             Counsel for the appellant states that on payment of the arrears of electricity dues, respondent has restored the electric connection.  Since the appellant has paid the entire arrears and a new electric meter stands in his name, the appeal has become infructuous and is dismissed as such.
