ORDER

Counsel for the parties present. Order passed by the State Commission is reads as follows: resent : None for the Appellant None for the Respondent Appellant as well as his counsel are absent. Respondents are also absent. Record reflects that appellant as well as its counsel were absent on late date. Hence, the appeal deserves to be dismissed and accordingly, it is dismissed. No order as to costs. Second time, the counsel for the petitioner submits that notices were yet to be issued to the respondent. Counsel for the petitioner submits he did not find out the next date of hearing and the case was dismissed in default. This is no ground. It is required that the arguing counsel should be more vigilant while dealing with the cases of litigant. However, in the interest of justice, the appeal is restored, subject to payment of cost of Rs.5,000/-. The same shall be deposited with the State Commission within a period of two weeks. Parties are directed to appear before the State Commission on 10th January 2013. The matter stands disposed of.
