This appeal was lying on sine-die list.  Notices were issued to both the parties when the matter was taken out from the sine-die list.  Notices are served to the appellant as well as respondent.  Adv.S.S.Jinsiwale is present for the respondent.  He undertakes in writing to file vakalatnama.  None is present or the appellant though notice is duly served.  Appellant failed to appear without any sufficient reason in spite of receipt of notice from this Commission.  It is not desirable to prolong old appeal when the appellant is not interested.  Appeal is dismissed in default.  Parties to bear their own costs.
