ORDER   (Passed on 07.02.2013)   Per Mr S M Shembole, Hon’ble Presiding Member       All appellants No. 1 to 6 as well as their counsel are absent. Mr G C Chavan, Asstt. Engineer of respondents is appeared and submitted that the appellants are not willing to proceed with the appeal and accordingly they have given in writing. He has produced the letter / Pursis given by the appellants. But it does not know as to before whom they have signed the letter / Pursis. Therefore, same cannot be relied on.        However, on 17.12.2012 notice was issued to the appellants as well as respondents and in response to the notice the Asstt. Engineer of the respondents appeared. But no report about service of notice to the appellants is received. However, office copy of the notice reflects that it was issued on correct address of appellants 4 as shown in the appeal memo as well as in the complaint. Therefore, it will have to be presumed that they are served with notice but they are absent.        Hence, appeal deserves to be dismissed in default and accordingly, it is dismissed.   No order as to cost.   Copy of this order be supplied to the parties.
