ORDER   (Passed on 08.10.2012)       Per Mr S M Shembole, Hon’ble Presiding Member       Both the appellants are absent. On 30.08.2012 notice was issued to appellants as well as respondents and in response to the notice respondent appeared through Adv. Mr A M Quazi. But till today, no report about service of notice to is received. However, on perusal of office copy of the notice it reflects that it was issued on correct address of the appellants as shown in the appeal memo. Hence, it will have to be presumed that they are served with the notice, but they are absent. Hence, there is no alternative except to dismiss the appeal in default. Therefore, it be recalled at 3.00 p.m.       Matter is recalled at 3.17 p.m. but nobody for the appellants is turned up.       Hence, appeal is dismissed in default.    No order as to cost.   Copy of this order be supplied to the parties.
