As per Hon’ble President  Mr. Atul  Alshi.

1.             This complaint is filed against the MSEDCL for not providing electric connection.

2.             The complainant is agriculturist having 1.33 H.R. agriculture land at  Pardi (Gotmare), Tah.Katol, District Nagpur and he had applied for electric supply L.T. (three phase) and deposited Rs.5,200/- on 16/12/2016 towards connection charges. But the O.P. after several request unable to issue electric connection in reasonable time. The complainant thereafter, issued legal notice through Adv. Lavale on 08/10/2020. But O.P. neither complied nor replied the notice. The complainant wants to take the crop of orange and sweet lemon. Due to non supply of electricity the complainant loss Rs.3,00,000/- P.A. from agriculture income. If the O.P. sanctioned electric supply to the complainant could have earned Rs.10,00,000/- within 3 years. Therefore non allotment of electric supply amounts to deficiency of service. Hence, this complaint filed.

3.                         The O.P. filed reply and denied the allegations against it and submitted that the complainant had applied for electric connection which is more than 600 mtrs from the well situated in the field of complainant. As per Circular No. 9529 dtd. 25/04/2018 of O.P. the electricity supply can be given upto 100 mtrs from the well through High Voltage Distribution supply. The complainant’s well is situated for more than 600 mtrs from electric supply. In that case, the complainant can get solar pump for getting electric supply. But for that the complainant is ready for expenses of more than Rs.2,50,000/-. The complainant has never applied for solar pump for electric supply. Therefore, the complainant has no merit in present case and liable to be dismissed with cost.

4.                                     As per Circular Mahavitaran bearing No. 9529 dtd.25/04/2018, the electric supply is possible to give to the farmers who’s well is situated within 100 mtrs from High Voltage distribution supply. The complainant’s well is situated 600 mtrs long from electric supply. In that case, the complainant can get solar pump electric supply. The complainant is ready for solar pump supply and ready to pay the amount of Rs.2,50,000/- approximately from his own expenses.     The complainant has failed to file application for supply from solar scheme on record. Therefore, there is no deficiency on the part of O.P. in installation of electric connection. Hence, there is no merit in presence case. Therefore complaint case is dismissed.

ORDER

1. The complaint is dismissed with no order as to cost.
2. Copy of the order shall be given to both the parties, free of cost.
