          Present appeal is lying on sine-die list.  Notices were issued to both the parties when the appeal was taken out from sine-die list.  Notices issued are duly served to appellant and respondent No.1.  Mr.Rajesh Lodge, Advocate present for respondent No.1 files Vakalatnama. None present for the appellant though appellant is duly served.  Present appeal is pending since 1999.  Appellant failed to appear before this Commission without any sufficient reason in spite of receipt of notice.  It appears that appellant is not diligent in contesting this appeal.  Hence, appeal stands dismissed for default.  Parties to bear their own costs.  Copies of the order be furnished to the parties.
