Present:     Complainant in person with Sh. S.P. Banchal, Adv. 

                  Sh. Rahul Dua, Area Collection Officer with Sh. Rajiv Khurana, Adv. for Ops.       

 

                File taken up today on the application moved by the counsel for the complainant. Shri Rahul Dua, Area Collection Officer of the OPs has made a statement to the effect that they have compromised with the complainant and as per compromise the complainant is bound to pay Rs.1,50,000/- to the company. He has also made statement that he has received the above said amount of Rs.1,50,000/- from the complainant and now nothing remains due towards the complainant of his loan account and the OPs are also bound to withdraw all the litigation in each and every court relating to this loan account. Further, the OP-company shall issue the “No Objection Certificate” within 45 days and if any guarantee stands towards the complainant, the company will not issue the “No Objection Certificate” to the complainant.

2.            The complainant has also made statement to the effect that he has compromised with the OPs-company and as per compromise he has made the payment of Rs.1,50,000/- in cash and the OPs-company is bound to withdraw all the litigation relating to the above said loan account from each and every court. He further prayed that the OPs be directed to issue the “No Objection Certificate” and as per the statement given by the representative of the company, he withdraw the present complaint. 3.       

             In view of the statements of the parties, the present complaint is dismissed as withdrawn being compromised. Both the parties shall be bound by their respective statements. File be consigned to record after due compliance.
