ORDER

Shri Sudip Majumder- President-in-Charge.

            Today is fixed for passing order in respect of the petition filed by the OP/Magma HDI GIC Ltd. dated 22/09/2023. Both the parties are present. Already heard Ld. Advocates for the both sides.

            One petition has been filed by the OP/Magma HDI GIC Ltd. The same has been registered as M.A. Case being No. 51/2023. Record is now taken up for passing order.

            Perused the petition. Considered. From the content of the petition it appears that the alleged vehicle was hypothecated  to Tata Motors Finance Ltd., which is a necessary party to this case for proper adjudication. Thus, the OP/Magma HDI GIC Ltd. prays before this Commission for directing the complainant to make the Financer party to this case.

            Ld. Advocate for the complainant is present at the time of hearing and no objection raised in respect of allowing the prayer of the OP side.

            In the instant case, this Commission is of view that as the alleged vehicle was hypothecated to the Tata Motors Finance Ltd., which is a necessary party to this case for proper adjudication.

            Hence, the petition being M.A. Case being No. 51/2023 is considered and allowed on contest without any cost. Complainant is directed to make the Financer party to this case.

Thus the M.A. Case being No. 51/2023 is disposed of.

            Fix. 09/01/2024 for compliance.

Copy of this order be supplied to the parties each at free of cost.
