Order dated 30.12.15 –The Adv. for complainant has sent a petition through post stating that in the meantime arbitration award has already been passed in favour of the Op. Party without knowledge of the complainant and it comes to the knowledge of the complainant after the written version filed by the Op. Party. So as per settle principle of Law “a complain petition cannot be decided by the consumer forum after an arbitration award has already passed since 17.08.12”. So this Hon’ble Forum has no jurisdiction to pass any relief in this context the complaint petition may kindly be disposed of. We perused the petition. Copy received by the Adv. for Op. Party. Hence the petition filed by the Adv. for complainant is allowed and the Complaint Petition is dropped as withdrawn.
