Execution Application under 71 Consumer Protection Act, 2019

Present:        DH/Complainant in person.

                     Sh. Rajesh Kumar Moudgil, Advocate, counsel for the JDs/OPs.

                     Sh. Pravin Vijay Kharade, Asstt. Police Inspector, Mahim Police   Station Mumbai.

         

          Today the case is fixed for appearance of JD. Power of attorney filed on behalf of the JD/OP. Shri Pravin Vijay Kharade, Asstt. Police Inspector, Mumbai Police has produced Shri Dnyanaraj Sudhir Moravekar, Chairman/Owner, Panormic Holidays Ltd. (Magic Holidays) before the Commission alongwith police report, which is taken on record, in compliance of bailable warrants issued vide No. 2614 dated 09.11.2021 for production of said JD.

          The calculation sheet filed by the DH/Complainant. At this stage, the DH/Complainant, by making a separate statement, stated that he has received an amount of Rs. 81,370/- which is credited in his saving account No.20042259922, State Bank of India, Sector-10, Panchkula as full and final payment and now, nothing is due against the JDs and thus, he withdraws the present execution application being fully satisfied.

         

          Heard. In view of the statement made by the DH/Complainant, the present execution application is hereby dismissed as withdrawn, being fully satisfied. Shri Dnyanaraj, JD is hereby ordered to be discharged. Shri Pravin Kharade, Assistant Police Inspector is hereby directed to release Shri Dnyanaraj, JD from custody.

                     A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
