The J.Dr. in pursuance of the order passed by the Hon’ble State Commission submitted to have allotted to site in favour of the D.Hr. but the counsel for the D.Hr. submitted that it is irregular in its dimension not suitable for construction of house, on which the counsel for the J.Dr. submitted that all the sites available with them are of irregular dimension and they have no objection for the D.Hr. to identify the site suitable to him and they will allott the same to him. This Forum also directed the D.Hr. to identify the site suitable to him, the J.Dr. admittedly has given a list of 25 sites to the counsel for the D.Hr. to identify one of them, but the counsel is not prepared to identify any site suitable to the D.Hr. and insisting upon the D.Hr. to furnish further particulars. In view of this, the Forum left to the chance of the D.Hr. to identify the site suitable to him, but has not come forward, as such we do not find any justification for keeping this petition pending without any progress. Therefore, giving liberty to the D.Hr. to identify the site of his choice and then to approach the Forum, the present execution petition is closed.
