ORDER

This order is pronounced in the open court on separate sheets of paper today. This complaint is allowed in part. The complainant is held entitled to the allotment of a site measuring 60 X 40 in sathagalli layout and the refund of Rs. 16,760/- together with interest at 12% p.a. from the date of payment till the date of realization and Rs.5,000/- as compensation for mental and physical agony that he suffered together with Rs.500/- towards the costs of this proceedings. The 1st respondent shall allot a site measuring 60 X 40 in Sathagalli layout within 3 months after the layout is formed with all civic amenities and to refund the amount of Rs.16,760/- together with interest at 12% p.a. from the date of payment till the date of realization and Rs.5,000/- as compensation for mental and physical agony that the complainant suffered together with Rs.500/- towards the costs of this proceedings to the complainant within 3 months from the date of receipt of the copy of this judgment and order. The complaint as against the 2nd respondent is hereby rejected. Send the certified copies of this judgment and order to both sides parties by R.P.A.D. immediately.
