Appellants are the opposite parties/insurance company in CC.29/10 in the file of CDRF, Palakkad.  The appellants are under orders to pay a sum of Rs.1,78,000/- with interest at 12% from the date of filing and cost of Rs.2000/-.

2.      The matter related to the own damage claim with respect to the vehicle owned by the complainant.  The opposite party/appellant was exparte before the Forum.  In the circumstances and in view of the fact, that the order is not a considered one the order of the Forum is set aside on condition that the appellant pay a sum of Rs.10,000/- towards cost to the complainant or deposit the same before the Forum which can be withdrawn by the complainant.   On payment of cost and Forum will issue notice to the complainant and permit the opposite parties to file version and contest the matter.

The case is posted before the Forum on 10/5/2011.

The office will forward copy of this order to the Forum urgently.
