None fore the appellant is present. On the last date it was directed to issue notice to both the parties. In response to the notice Mr.Gajendra, S/o Respondent Madhukar Wasankar appeared and submitted that the Respondent is unable to attend this commission as he is bedridden. Further he submits that his counsel are not ready to appear and, he is unable to engage another counsel. The report of the notice issued to the appellant is not received. On perusal of the office copy of the notice it reflects that it was issued on the correct address of the appellant as shown in the appeal memo. Therefore, it will have to be presumed that the directors of the appellant are served with notice, but they did not turned up. Therefore, the appeal deserves to be dismissed in default. Accordingly the appeal is dismissed in default. No order as to costs.
