File put up today on the application for early hearing of the matter.
It is stated that parties have amicably settled the matter as such the early hearing be given and the settlement between the parties be taken on record. The application is supported with affidavit of the appellant.
Respondent is present in person who has shown her passport as proof of identification. Photocopy of same is retained.
Ld. Counsel for the appellant has also stated that he also identifies the respondent.
In view of the reasoning given, early hearing is allowed. The date of hearing is preponed and the appeal is taken up today.
It is stated that the matter has been amicably settled between the parties vide settlement agreement dated 27.3.15. The respondent has stated having signed at point ‘A’ of each page of settlement Ex-C1.
On behalf of the appellant, Ld. Counsel for appellant states that the settlement is signed at point ‘B’ on each page of settlement by Shri Atul Srivastava, AR of the appellant.
In terms of settlement Ex-C1, a cheque of Rs.5,50,000/- has been given to the respondent. Photocopy of the same is retained.
Since the parties have amicably settled the matter as is stated above, the impugned order stands modified in terms of settlement Ex-C1.
The appeal stands disposed of accordingly.
Parties shall remain bound by the terms of settlement.
File be consigned to record room.
