                 Today the case is fixed for notice to the JD-1.          

      At this stage, learned counsel for the DH/complainant suffered his separate statement to the effect that he does not wants to pursue the present miscellaneous application withdraws the same and sought permission to file the fresh miscellaneous application on the same cause of action before the competent Court of law.      

                In view of statement of learned counsel for the DH/complainant, the present miscellaneous application is hereby dismissed as withdrawn. However, the DH/complainant is at liberty to file fresh miscellaneous application on the same cause of action, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
