- The Complainant in order to purchase some doors paid an advance of Rs. 2.5 lakhs to the O.P. to supply dry wood. When the Complainant received the doors found that some doors are damaged. The damaged doors are returned and only 30 doors were kept. The value of doors are Rs. 6500/- x 30=Rs.1,95,000/-. The O.P. only returned Rs. 10,000/- and after several request also not refunded the balance amount. Being harassed complaint was filed.
- The O.P. in reply submitted that the O.P. is a carpenter and as per direction of complainant manufactured the doors. The Complainant not paid Rs. 2.5 lakhs as alleged. The Complainant received 33 doors as per his choice. The Complainant not mentioned clearly the specification of the doors as it ranges from Rs. 2000/- to Rs. 1.00 lakh. The rate mentioned Rs. 6500/- is not correct. The Complainant is not entitled for Rs. 55,550/- as claimed. As per order doors are prepared.
- The Complainant filed whatsapp message conversation, Bill dated 12.03.2019 of Krishna Traders, receipt dated 03.03.2021 wherein Mahabir Biswakarma received Rs. 40,000/-, bill dated 13.06.2017 of Jalaram Timbers, Depo permit dated 13.06.2017, depo permit dated 12.03.2019. From documents filed it reveals that the O.P. is a carpenter and there is business relationship between both the parties. As per document relationship exist since 2017 and time to time Complainant giving payment to the O.P. The Complainant to substantiate his case not filed any documents that the Complainant purchased 30 doors. In whatsapp message refund of Rs. 10,000/- discussion has been made.
The complainant failed to establish that Rs. 2.5 lakhs paid to O.P. and also cost of the doors. The dispute between the parties are civil in nature. The Complainant is liberty to move to Civil Court for redressal. The complaint is dismissed.
Order pronounced in the open court on 30th day of Sept, 2024.
