Today is fixed for hearing of this M.A. application which has been filed by the complainant for appointment of the expert in the matter of testing the potato seeds which has been kept in the Maa Annapurna Sheet Grah, Singerkone, Kalna, Dist. Purba Bardhhaman, PIN. 713122 under bond no. 4305 which was received on 23.3.2022 as per bond paper serial no. 5580 and issuance date from no. 6-31.3.2022 standing in the name of SahidulKarim of Ballaldighi Dist. Hooghly.

The op is contesting this matter by filing W/O and raised question about the identification of the seed.

For the interest of arriving at just and proper decision over this issue this District Commission after going through the material of this case record as well as the material of mother case record bearing no. C.C. 140 of 2022 finds that the op in their W/V has raised this issue of expert examination of the potato seeds.

In view of this position the op at this stage cannot raise any objection in the matter of expert examination of the potato seeds. Moreover for the interest of proper and complete adjudication of this case the prayer of the applicant of this M.A. case for expert examination of the potato seeds described in the M.A. case is allowed on contest.

Let Seed Testing Authority, Seed Testing Officer, State Seed Testing Laboratory, District Agricultural Firm, KalnaBardhaman Road, near APC Training Center, Barddhaman Town, Dist. PurbaBardhaman, PIN. 713101 be appointed as seed testing officer and he is directed to collect sample from the above noted cold storage and to test the same as per petition dt.1.12.2022 of the complainant.

Complainant shall bear the entire cost of this expert. Complainant is directed to take steps in this regard.

Let a copy of this order be sent to Seed Testing Authority, Seed Testing Officer, State Seed Testing Laboratory, District Agricultural Firm, KalnaBardhaman Road, near APC Training Center, Barddhaman Town, Dist. PurbaBardhaman, PIN. 713101 with intimation for informing this office about the cost of the expert examination.

Fix 23.2.2023 for taking steps by the complainant in the light of this order.

Thus, this M.A case no. 82 of 2022 is disposed of on contest.

No order is passed as to costs.
