Today is fixed for hearing the petition dated 19/09/2023 filed by O.P No. 1. Ld. Advocate for the Complainant is present. Ld. Advocate for the O.P No. 1 is present.

Hence, the petition dated 19/09/2023 is rejected being not pressed.

M.A. case no. 190/2023 is thus disposed of.

Today, O.P No. 1 files another petition praying for dismissal of this case. Petition is registered as M.A. case no. 206/2023. Petition is taken up for hearing. Heard both sides. Record is taken up for order.

In this context we have carefully gone through the decision of Hon’ble SC.D.R.C.

We find that Hon’ble S.C.D.R.C observed that inspite of existence of arbitration clause in the agreement, District Commission has the jurisdiction to entertain the complaint if lodged by any party to the agreement.

In view of above we find that aforesaid petition is devoid of merits. Hence, the petition dated 22/12/2023 filed by the O.P No. 1 is considered and rejected.

M.A. case no. 206/2023 is thus disposed of.
