 Appellant Deepak as well as his counsel Shri Kullarwar are absent. They are absent since long. Therefore, on the last date, it was directed to issue notice to the appellant. Accordingly, notice was issued on 12/9/2011, but no report is received till today. The office copy of the notice reflects that it was issued on the correct address of the appellant as given in the appeal memo. Hence it will have to be presumed that the appellant is served with notice, but he did not turned up. Adv.Mohril for the Respondent is present. He was also present on the last date. Hence the appeal is dismissed in default.
