None is present for the appellant. Adv.Smt.S.C.Deo appeared for Resp. and filed power.  The perusal of R&P shows that Adv.Sachin Jaiswal had appeared for appellant on 9/4/14 and he had made a submission that probably the matter is already settled. However, thereafter, though the appeal came to be adjourned twice i.e. on 17/6/14 and 1/8/14, none appeared for the appellant. Adv.Mrs.Deo submitted that she has not received copy of appeal compilation from the appellant. Adv.for appellant was directed on 17/6/14 to supply copy of appeal compilation to the respondent, but that direction is also not complied by the appellant as yet. On last two dates also none had appeared for the appellant and appellant has taken no steps for progress of the appeal.  Hence the appeal deserves to be dismissed. Appeal be recalled at 3.00 p.m. for order.

The matter is recalled at   3.30   p.m. today. Presently also none appeared for the appellant. Hence the appeal is dismissed in default.
