ORDER
The complaints are allowed. The Opposite Parties are jointly and severally is hereby directed to rectify the following defects in the complainant’s apartments:-
(a). To get the completion certificate and proper Door numbers to the Apartments belonging to the complainants and convey the Apartments to the complainants with a clear marketable title.
(b). To set right the defective flooring work, telephone point, latches and locks provided to the door system. To set right the defect of accumulation of water in the balcony, to set right the flow of water from bathroom to the master bed room and to set right the flush of the commode. To set right the lfit facility, crack in the walls seepage in the walls and to plaster the outer portion of the compound wall. To set right the level of interlock fixed to Star Legacy I Apartment. To set right the Electrical room. To set right the borewell and make the water usable and seepage in the walls.
(c). To complete and provide land scaped garded, children play park, recreation, health Club, intercom, visitors lobby with marble/granite flooring, good quality decorative flush door for rooms and Fibrotech/P.V.C. shutters for toilets, separate pastel coloured wash basin for dining, stainless steel washing sink with drain board, 2 Power points and exhaust fan provisions. To provide a separate provision for passing of rain water from the top portion of the rain water. To provide proper accounts for the maintenance of the Apartment.
(d). To replace wooden door frames in place of concrete door frames.
(e). To provide accounts for the maintenance charges already collected by the Opposite Parties and to provide the use of common areas and facilities to all the occupants.
Apart from set righting the defects the Opposite Parties shall pay Rs.50,000/- each towards the damages in case of failure to issue a completion certificate within three months in case of failure to provide within the stipulated time the Opposite Parties are liable to pay Rs.500/- per day from the date failure till the date of issuance certificate with permanent door number. Further double tax collected by the M.C.C. shall be borne by Opposite Parties till set righting the above problems. Further pay Rs.4,000/- each (which includes commissioner’s fee) to the Complainants. Compliance/payment shall be made within 30 days from the date of this order.
In case of failure to pay the above mentioned amount within the stipulated time, the Opposite Parties are jointly and severally directed to pay interest at the rate of 12% per annum on the above said total amount from the date of failure till the date of payment.
Copy of this order as per statutory requirements, be forward to the parties free of costs and file shall be consigned to record room.
