This Complaint is filed by the Complainant u/s. 12 of the C.P. Act  to recover the pledged Gold ornaments from the OP.

 

2.       The Complainant is being the brother of deceased Ravi who pledged the Jewels with the OP and he was died on 16.07.2010.   During his life time deceased Ravi has pledged four gold items in the OP shop.

 

3.       On perusal of the Complaint filed by one Raju, it is seen that the very next legal heir is his mother Bhadramma is alive.  The deceased has left behind his mother Bhadramma who is the only Class-I heir. 

 

4.       The Complainant is the brother of deceased Ravi who is Class-II heir.  Because of this, the deceased Ravi’s mother Smt. Bhadramma alone can file Complaint for which this order will not come in the way.  She is at liberty to file such complaint / suit as she deems fit or advised so.  In view of this, in our opinion, Complaint is liable to be dismissed.  Hence, we proceed to pass the following:

 

ORDER

1.       Complaint is dismissed.

 

2.       Office is directed to return extra sets to the parties concerned under the Regulation 20(3) of the Consumer Protection Regulations 2005.

 

3.       Send free copy of the order to the parties.

 

4.       Dictated to the Stenographer, got it transcribed and corrected and pronounced in the open Forum on this the 20th day of March 2012.
