                                                JUDGMENT

JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT

The appellants are the opposite party/KSEB in CC.230/07 in the file of CDRF, Thrissur. The R.R notice for a sum of Rs.35388/- issued by the appellants stands cancelled.
          2. Ext.P1 notice for the above sum is dated 15.1.07. The bill issued for a sum of Rs.1271/- for July 2003 was not paid and electrical connection was disconnected. The appellants dismantled the connection only on 2006. Hence for the entire period the amount is claimed towards the fixed charges and surcharge.
          3. The evidence adduced consisted of Exts.P1 to P4. No evidence was adduced by the opposite parties/respondents.
          4. According to the complainant, he had applied for dismanting the connection on 5.9.03. We find that even otherwise the appellants are bound to do so by the statutory provisions   if the electrical charges are not paid and subsequent to disconnection.
In the circumstances, issuance of the bill claiming a sum of Rs.35,388/- is clearly unauthorized.
Hence, we find that there is no scope for admitting the appeal. The appeal is dismissed in- limine.
Office will forward copy of this order  to the Forum urgently.
